Lawyers explained how many times the TCC can impose fines for violating military registration.


In the last three months, over 11 thousand fines have been imposed in Ukraine for violations of mobilization legislation, and since the beginning of the year, over 28 thousand relevant proceedings have been registered. This is evidenced by data from open sources.
Lawyers specializing in mobilization issues predict further strengthening of this process. They also do not rule out the possibility of imposing multiple fines on a single person for various violations of the current legislation.
'There can be several violations of military registration rules,' explains lawyer Andriy Mezheirytsky in a commentary for TSN. According to him, theoretically, each violation can be recorded in a separate protocol and resolution.
'I admit that there may be several fines for one person. For example, for not updating military registration data, for the absence of a military ID — that is, when a person is actually not registered, did not appear at the Military Medical Commission by June 5, if deemed conditionally fit. All these are separate violations. There may be three protocols and three fines. Legally, this is possible,' explains the expert.
Mezheirytsky notes that employees of territorial recruitment centers can frequently send summons and impose fines for non-appearance for each of them. According to his estimates, TCCs are currently more actively using the practice of imposing fines and will obviously continue this trend.
At the same Time, the lawyer criticizes the quality of the materials prepared by TCCs: 'there are very many errors, which is why courts cancel fines. Even if a person has violations. For example, the wrong articles and dates are indicated in the materials.'
Violations of legislation and fines
Lawyer and former investigator Roman Simutin confirms the reality of the situation with multiple fines but emphasizes that they are imposed at different times. 'For a conscript not appearing for a summons on a certain date, and then for a summons that was sent, for example, three weeks later. A fine for refusing to undergo the Military Medical Commission may be imposed,' says Simutin. According to him, most violators usually receive the maximum fine of 25 thousand 500 hryvnias.
Simutin also draws attention to an important date — July 17, 2025, when a year will have passed since the deadline by which men aged 18 to 60 should have updated their data. 'The one-year statute of limitations for prosecution expires,' notes the lawyer. He interprets this legal norm as meaning that imposing a fine after July 17, 2025, will be questionable. Regarding other violations of mobilization legislation, the expert predicts an increase in the number of fines.
Lawyer Kateryna Anishchenko, who also specializes in issues of mobilization legislation, confirms the principle of 'one summons — one fine.'
She provides a specific example of a complicated situation: a person was removed from military registration in 2012, but did not register again as required by law. Now this person has a disabled child and is trying to get a deferment. The man has a conditionally fit status, he faced two fines — for untimely registration and for not undergoing the military medical commission by June 5. He paid one fine, but there were nuances regarding the second violation related to expiration of the statute of limitations for prosecution.
Ukraine has significantly strengthened control over compliance with mobilization legislation, which has led to an increase in the number of imposed fines for violations. The legal community predicts further growth in the number of fines and emphasizes the importance of complying with legal requirements, particularly regarding compulsory military registration and undergoing the military medical commission within the established deadlines.
