Land allocation for construction: new rules and requirements.


Residents are no longer allowed to use detailed plans of territories to plan their areas and change the designation of land plots for construction. Now, a spatial development plan is required to avoid chaotic construction and land raiding, as noted by the head of the Verkhovna Rada Committee Olena Shuliak. This restriction concerns construction companies that have local authorities.
Shuliak explained that most Ukrainian cities do not have an updated comprehensive development plan, including Kyiv. Legislation allowed changing the general plan through detailed plans of territories, but did not clearly define the boundaries for such changes. This allowed unscrupulous developers to make deals with local authorities and alter the general plans in contradictory ways. Land plot designations for construction were determined on this basis, and permits were issued. This led to chaos, overloaded roads, a municipal crisis, and other issues, as noted by the member of parliament.
“Unscrupulous developers took advantage of this, and in agreements with local authorities, conducted detailed planning that 'clarified' the general plan in a way that contradicted it. Based on this, land plot designations for construction were determined, and permits were obtained. As a result, we have a constant struggle with chaos, congested roads, a municipal crisis, and other problems,” said the member of parliament.
She noted that the new document is urban planning and land management documentation at the local level, covering the entire territory of the community. Its term is unlimited but can be changed every year.
The comprehensive plan divides the territory into different functional zones, such as residential development, industry, etc. A list of land plot designations is specified for each zone, from which owners can choose the most promising options.
