Can an employer refuse to grant leave upon the birth of a child? Explanation from DerzhPratsi.


Employers cannot refuse parents leave upon the birth of a child if they do not work at critical infrastructure facilities. This was reported by the Central-West Interregional Department of DerzhPratsi.
According to the legislation, the child's father or the woman's husband who gave birth has the right to a 14-day paid leave. Other relatives can also receive leave if the child's parents are single. It is important that the leave is granted to only one person.
Who is entitled to leave upon the birth of a child?
The right to such leave belongs to the child's father or the husband whose wife gave birth or other relatives (if the child's mother or father is single). This leave is granted to only one person.
How to get leave upon the birth of a child?
To exercise this right, the employee must submit an application to the employer no later than three months from the date of the child's birth. The only exception is employees at critical infrastructure facilities. During the period of martial law, the employer has the right to refuse them leave.
